CJ Omar Ata Bandial orders for fair trial of the killers cops

Lahore: The Chief Justice of Lahore High Court has directed District and Sessions Judge, Lahore to issue appropriate direction to the CCPO and the Inquiry Officer (IO) for carrying on fair investigation on true lines.

Hon’ble CJ had taken notice of a news item published in daily “Express” dated 18.12.2012 regarding death of a 26-year old boy while on physical remand with the Shadbagh Police and directed the D&SJ, Lahore to look into the matter and submit detail report and comments in the matter. The D&SJ after probing into the matter submitted that according to Incharge Investigation, PS Shadbagh, accused Mohsin Akram son of Muhammad Akram having been involved in number of criminal cases was on physical remand and he died during custody of Police. The report further shows that post-mortem-examination of the deceased was also got conducted. However, reports from the offices of Chemical Examiner and Forensic Science Laboratory are awaited and the Police authorities have not approached D&SJ Lahore for deputing a Judicial Officer for conducting judicial inquiry into the matter.

After perusal of the above said report, Hon’ble CJ directed D&SJ Lahore to take the following actions u/s 22-A, 22-B Cr,P.C: –

1.An appropriate direction be issued to the CCPO and the Inquiry Officer (IO) for fair investigation on true lines

2.The I.O. be directed to secure complete evidence during the investigation.

3.The CCPO and the IO also be directed to secure all documentary evidence/reports from concerned experts and annex with police report u/s 173 Cr.P.C.

4.The local police be directed to file report u/s 173 Cr.P.C. within the stipulated period in order to enable the court to do the complete justice.
