Karachi:Dr. Arif Alvi Secretary General Pakistan Tehreek-e-Insaf through his lawyer Mr. Osman A. Hadi has invoked the Constitutional Jurisdiction of the Honorable High Court of Sindh at Karachi in a written petition filed against Mr. Yusuf Raza Gilani.
The petition states that in light of the Order passed by the Supreme Court of Pakistan on 26th April, followed by a detailed judgment, Mr Yousuf Raza Gilani was convicted of contempt of court and was sentenced until rising of the Court. A ruling accepted by him as no appeal was filed. The order further declared that Mr Gilani brought the Judiciary of Pakistan into ridicule thereby rendering Mr. Gilani automatically disqualified from holding a seat of National Assembly by virtue of Article 63 (1) (g) of the Constitution of the Islamic Republic of Pakistan 1973.
Dr Alvi, from PTI, through this constitutional petition has asked Mr Gilani to show under what authority he continues to hold office of the Prime Minister of Pakistan and has prayed that the Court should declare that Mr Gilani has ceased to be the Prime Minister of Pakistan, and that all actions taken by Mr Gilani subsequent to his sentencing on 26th April as Prime Minister of Pakistan are void and of no effect. He said that the presence of a person illegally in the Prime Minister’s office is encroachment on his and the masses rights as a citizens of Sindh and of Pakistan.
