Rana Mashhood Ahmad Khan complains chairman NAB about DG NAB Punjab

Provincial minister Rana Mashhood letter details are written below;

Dear Sir,

I want to draw your attention to an important matter in which one of your Officer D.G. NAB Punjab Major (R) Syed Burhan Ali has blatantly transgressed his authority and misused the name of NAB in clear cut violation of the Code of Conduct enunciated by NAB. The undersigned did not take his first statement seriously aired on 09-09-2015 as he does not require any certificate of his credibility, but his imprudent act initiated a media trial of the undersigned. He got exceptional coverage in newspapers and electronic media. The TV channels on his statement started declaring me as a corrupt person which has not only injured my reputation but has also excruciating effect on good will and honour of my family.

On 17-09-2015 in program “Off the Record” ARY News he again stated that NAB Authorities have started proceedings against Rana Mashhood Ahmad Khan, Minister for Education on the reports of Media, a day earlier and Mr. Kashif Abbassi categorically told him that a day earlier NAB has asked for CDs last night. It means that statement dated 09-09-2015 was only for his personal gains.

On the same day in a press conference, he categorically stated that a complaint has been filed against Rana Mashhood and NAB Authorities have taken cognizance of the same against him and two other MNAs of the same party but he did not give names of those MNAs which shows his malafide intent.

I must say that D.G. NAB, Punjab has no authority to comment on any matter publically which is under inquiry or investigation as per National Accountability Ordinance, 1999. The statement given by him seems to personify his image in public through print and electronic media intentionally, which can be simply ascertained from his wordings uttered on 09-09-2015 that he put words in the mouth of anchors as no one had specifically put question to him about me but for his self projection at the expense of my vilification he attempted to boost his public image. Further, in press conference on 17-09-2015 he also stated that a compliant has been received by NAB.

The undersigned need the copy of complaint as well, as it is a constitutional right under Article 19-A of the Constitution of Islamic Republic of Pakistan, 1973.

I must bring into your notice that D.G. NAB Punjab has violated National Accountability Bureau (NAB) Employees Terms and Conditions of Services (TCS), 2002 and Code of Conduct and Ethics of NAB. Through his act he has generated hostility which is likely to create embarrassment and defamation. In the Guidelines for the Code of Conduct, an employee of a NAB has to maintain impartiality with integrity and should act fairly, following the Fundamental Rights granted by the Constitution of Islamic Republic of Pakistan, 1973, keeping his personal issues and advantages aside. The press conference dated 17-09-2015 and his statement in TV channel compelled me to inform you that his action are liable to be taken to task as his statements which are not warranted by NAB Laws and are liable to be treated as defamation as per NAB Law and Defamation Ordinance 2002.

The said officer has also violated clause 3.6 of NAB Code of Conduct, in which a NAB employee should avoid to involve in such activity which create doubt against NAB by positioning the Authority in uncomfortable situation, furthermore, his act is violative to clause 4.1 of the Code, which clearly says that if any information is entrusted to the employee of the NAB, he is morally and legally bound not to disclose such information and it is specifically written in the clause that this act would tantamount to breach of security rules.

I also need a Copy of Permission given by Chairman/Deputy Chairman to him to disclose information publically as my legal right.

Mr. Burhan Ali first statement on 09-09-2015 of taking action against me and reiterating the same after a week through press conference and later on in TV programme appears to be an attempt to glorify his name in Media at the cost of my respect and honour in violation of NAB confidentiality policy. Similarly, by boasting himself through his statements he has cautiously breached the Code of Conduct. Clause 4.2 is reproduced for your information.

NAB’s work is often sensitive and requires confidentiality. The very sensitivity of the NAB’s activities makes it of interest to the community, and in particular, the media.

The unauthorized or improper release of information to the media may have the effect of compromising an investigation, adversely and unnecessarily affecting the reputation of individuals, or undermining public confidence in NAB.

It is, therefore, important to ensure that information considered appropriate only for public comment is released. This is generally done in coordination with the authorized media officer of NAB. Media management is presently being supervised by COS under the directions of Chairman/Deputy Chairman. Accordingly Media Advisor, Addl. Director (Media) and PRO (Media) are responsible for implementation of NAB’s media policy.

The Chairman NAB will authorize officers to make public comments on behalf of NAB. You must only make public comments with this authorization. If you receive any media inquiries, these should be referred to the concerned media officer who is the official spokesperson of NAB. Even if you do not provide any information to a journalist, inform the media officer of any approaches from the media for information or comments.

I hope the said clause is enough to establish his actions beyond his designated jurisdiction.

I hope you will be sending me the complaint which D.G. NAB has alleged to receive, Secondly, copy of document granting him permission to give public statements Thirdly, whether he has compromised clause 4.2 for his personal glorification. Fourthly the undersigned is willing to join any investigation, though the matter has already been adjudicated upon by Lahore High Court and Supreme Court of Pakistan still for the satisfaction and to preserve and protect his respect and honour which has been deliberately publicly tarnished by the statement of D.G. NAB. Fifthly, an appropriate action against him for misusing his authority and Sixthly, a public statement should be issued by your office apologizing for the act of Burhan Ali for violating the NAB Laws which should be issued within 15 days otherwise the undersigned has every right to initiate legal action against this derogatory and defamatory act of your officer.
